FSPHP Comments to California Medical Board Licensure Questions

The FSPHP responded to a public comment request by the CA Medical Board regarding health questions on their license application. The Medical Board of California held a forum on July 30th seeking comments on questions of licensing applications. The FSPHP response aligns with the FSPHP Safe Haven Task Force action plan setting forth FSPHP’s support for a triad of confidentiality in all states that creates a safe mechanism for physicians and healthcare professionals to seek help while maintaining the privacy of their protected private health information. The triad includes:
- Regulatory Protection: A state PHP is approved to accept confidential referrals without the involvement of the state medical board and may accept referrals in lieu of a medical board report in states that mandate reporting of impairment or potential impairment
- Record Protection: A PHP records are protected from discovery in legal proceedings
- Application Protection: PHP compliance permits non-disclosure of protected health information on licensure/credentialing/insurance and certification applications; such applications do not require disclosure of PHP participation.
